Terms and Conditions of Trading

Definition. All references to In Vino Veritas Ltd or just In Vino Veritas in this website shall be taken as referring to In Vino Veritas Limited, a company registered in England, company number 04418290.

Supplies. Orders are accepted subject to availability and vintages may vary from those shown in our lists, however all variations will be notified in writing before final confirmation of order. All lists are published in good faith and wines listed are correct at the time of issue, errors and omissions excepted (E&OE).

Prices. All quoted prices are in pounds sterling and are In Bond London and are exclusive of all taxes, duties and delivery charges unless otherwise stated. In the event that any applicable tax or duty charges change, then formal notice shall be given to clients in order for them to decide as to whether they wish to proceed with the order. Orders are accepted on a full payment with order basis unless otherwise agreed.

Payment. In Vino Veritas Ltd accepts payment by way of wire transfers. Credit is available for approved accounts, the terms of which will be agreed in writing between the Buyer and In Vino Veritas Ltd. All other orders are accepted on a 'full payment with order' basis only.

Delivery. Delivery will be in the manner and time as agreed with In Vino Veritas Ltd but In Vino Veritas Ltd will not be responsible for any variation caused by circumstances beyond its control, particularly where 3rd party Agents are used to handle the shipping. Delivery must be to one address unless otherwise agreed in writing with In Vino Veritas Ltd. All delivery charges will be confirmed before dispatch. Any warehouse transfers within the UK for which In Vino Veritas Ltd incurs a charge shall be invoiced to the Buyer unless the original order is of a net value of GBP2,000.00 or more.

Condition. Whilst In Vino Veritas Ltd makes every effort to ensure the proper cellaring of wines in our possession, we cannot be responsible for the condition of wines or whether they show any attributes which might be expected of them. We are not direct importers, therefore In Vino Veritas Ltd never guarantees against defects of the wine due to imperfect bottling (corking) or abnormal ageing that compromises the wine quality itself, regardless of the price.

Insurance. All deliveries will be fully insured at invoice price to the point of acceptance of the delivery by the Buyer or his Agent. Where goods are supplied on credit terms it is the responsibility of the Buyer or his Agent to ensure that the goods are insured at full market value once delivery has been accepted and prior to full payment for the goods being made to In Vino Veritas Ltd.

Consequential Loss. Any claim by the Buyer or his Agent for compensation for defective goods shall be limited to the actual cost of those goods. No liability will be accepted by In Vino Veritas Ltd in any way for any consequential loss or damage resulting from those goods however caused.

Import. Outside EU member countries it is the responsibility of the Buyer to ensure that all due import licences (where applicable) are in place before shipment of the goods and that all sales taxes and import duties are paid on arrival or as otherwise agreed between the Buyer or his Agent and the relevant authorities in the country of destination.

Claims. All goods purchased from In Vino Veritas Ltd must be examined on arrival by the receiving party, regardless of whether this is the Buyer, Consolidator or Agent, and any discrepancies must be marked on the delivery note as well as being notified separately in writing to In Vino Veritas Ltd within 10 days by the recipient. Non-delivery of goods must be similarly notified in writing within 14 days of the advised delivery date. In Vino Veritas Ltd cannot entertain claims when these conditions have not been met.

Good Faith. Goods are purchased by In Vino Veritas Ltd from primary, selected, and well known suppliers. On arrival they are always inspected, therefore we will always act in good faith. However if there's a complaint regarding the authenticity or suspected counterfeiting of the wine, this must be reported immediately, providing clear evidence of the reason for the claim, and in any case, the bottle still unopened. Any claims arising from the opening or mishandling of the wine shall not be considered.

Title. All goods supplied by In Vino Veritas Ltd shall remain the property of In Vino Veritas Ltd until the full purchase price, including all delivery and insurance charges, has been paid.

Cancellation of Orders. Cancellation of orders will only be accepted if made in writing within 7 days of confirmation of order and invoice date but prior to shipping. Once goods have been shipped, delivered & accepted by the Buyer or his Agent, cancellation of any order will not be accepted without a valid reason, i.e., goods substantially not as ordered. In Vino Veritas Ltd reserves the right to cancel any order should payment not have been received in full within 30 days of the due date.

Amendments. In Vino Veritas Ltd reserves the right to alter or amend these Terms and Conditions of Trading without notice, however all accepted and confirmed orders will be governed by the Terms and Conditions in force at the time of order.

Validity. Should any clause in these Terms and Conditions be held to be invalid, such invalidity shall not affect the validity of the remaining clauses.

Charges. Should any breach of contract such as non-payment or cancellation of orders by either party outside the contracted period be made, In Vino Veritas Ltd reserves the right to charge the client for all costs including overdraft charges, loss of profit, incurred shipping and insurance costs and interest (at 8% per annum over BOEBR). Should In Vino Veritas Ltd hold funds on account for any such client against which goods have not been supplied, or stock which has been paid for but not yet shipped, In Vino Veritas Ltd reserves the right to liquidate said goods in order to reclaim costs. All such costs are calculated at the sole discretion of In Vino Veritas Ltd, details of which may be requested at any time.

Applicable Law. Unless otherwise agreed in writing at the time of order, these Terms and Conditions and any disputes arising between the Buyer and In Vino Veritas Ltd will be subject to the Laws of England.
